Overview
Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ForexView mobile application (the "Service") operated by Forex View ("us", "we", or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
1. Service Description
ForexView provides users with access to foreign exchange (Forex) market information, including but not limited to currency pair quotes, charts, news feeds, economic calendars, and analytical tools (the "Information"). Crucially, the Service is for informational and educational purposes only. It does NOT provide: Financial or investment advice. Recommendations to buy, sell, or hold any currency or financial instrument. Trading capabilities or brokerage services. Any form of personalized financial guidance.
2. Acceptance of terms
By downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
3. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service strictly for your personal, non-commercial use, subject to these Terms.
4. User Responsibilities and Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: Use the Service in any way that violates any applicable Ugandan or international law or regulation. Use the Information provided by the Service to make investment or trading decisions without conducting your own thorough research and seeking independent professional financial advice. Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from us. Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful. Reverse engineer, decompile, or disassemble the Service.
5. Intellectual Property
The Service and its original content (excluding content provided by users or third parties like news feeds), features, and functionality are and will remain the exclusive property of ForexView and its licensors. The Service is protected by copyright, trademark, and other laws of both Uganda and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
6. Disclaimers
No Investment Advice: The Information provided through the Service is not intended as, and shall not be understood or construed as, financial or investment advice. The Information is general in nature and not specific to you. You should not rely on the Information as a substitute for professional advice tailored to your specific situation. Market Risk: Trading foreign exchange on margin carries a high level of risk and may not be suitable for all investors. The high degree of leverage can work against you as well as for you. Before deciding to trade foreign exchange, you should carefully consider your investment objectives, level of experience, and risk appetite. The possibility exists that you could sustain a loss of some or all of your initial investment and therefore you should not invest money that you cannot afford to lose. You should be aware of all the risks associated with foreign exchange trading and seek advice from an independent financial advisor if you have any doubts. Accuracy of Information: While we strive to provide accurate and up-to-date Information, we make no representations, warranties, or guarantees, whether express or implied, that the content on our Service is accurate, complete, or up-to-date. Data, including quotes and charts, may be delayed or may not be accurate. Information from third-party sources (e.g., news feeds) is provided "as is" without warranty of any kind. You should independently verify any Information before relying on it. No Guarantees: We do not guarantee any specific results or profits from the use of the Service or the Information provided. Past performance is not indicative of future results.
7. Limitation of Liability
To the fullest extent permitted by applicable Ugandan law, in no event shall Forex View, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. Our total liability to you for any damages arising from or related to these Terms or your use of the Service, regardless of the form of action, will at all times be limited to the greater of (a) the amount you have paid us, if any, in the past twelve months for the use of the Service or (b) fifty US dollars ($50 USD) or its equivalent in Ugandan Shillings.
8. Indemnification
You agree to defend, indemnify, and hold harmless Forex View and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
9. Privacy Policy
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and disclose information that pertains to your privacy. By using the Service, you agree to the terms of our Privacy Policy, including compliance with Uganda's Data Protection and Privacy Act, 2019, where applicable.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Uganda, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through amicable negotiation. If the dispute cannot be resolved through negotiation within 90 days, it shall be submitted to the competent courts of Kampala, Uganda.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15-30 days notice prior to any new terms taking effect, possibly via an in-app notification or by updating the "Last Updated" date. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
